Terms of Service

1. Agreement to Terms

By accessing or using Mimea (“the Platform”), available at mimea.co and through the Mimea mobile app (Android and iOS), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.

Mimea is operated by TrustTech Digital, a division of Bevon Co LLC (“we”, “us”, “our”).

2. Eligibility

You must be at least 18 years old to use Mimea. By using the Platform, you represent and warrant that you meet this age requirement.

3. Account Registration

To access certain features of Mimea, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate and current
  • Maintain the security and confidentiality of your password
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or provide false information.

4. Acceptable Use

You agree to use Mimea only for lawful purposes. You will not:

  • Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another’s privacy
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
  • Post spam, advertisements, or unsolicited commercial content without authorization
  • Attempt to gain unauthorized access to the Platform, other user accounts, or computer systems
  • Interfere with or disrupt the Platform or servers or networks connected to the Platform
  • Use automated tools (bots, scrapers) to access or collect data from the Platform without permission
  • Post content that infringes intellectual property rights, including copyrights, trademarks, patents, or trade secrets
  • Engage in any activity that violates applicable laws or regulations

5. Content Ownership and License

Your Content

You retain ownership of content you post on Mimea, including text posts, comments, photos, videos, and other materials (“User Content”). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display your User Content for the purpose of operating and improving the Platform.

You represent and warrant that you own or have the necessary rights to post your User Content and that it does not violate any third-party rights.

Our Content

All content provided by Mimea, including courses, articles, educational materials, design elements, logos, and trademarks, is owned by us or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

6. Community Guidelines

Mimea is a community platform focused on plant-based education and wellness. We expect all members to engage respectfully. Content that violates our community guidelines may be removed, and accounts may be suspended or terminated.

Community guidelines include:

  • Be respectful and constructive in discussions
  • No harassment, hate speech, or personal attacks
  • No misinformation or misleading health claims
  • Stay on topic in groups and discussions
  • No spam or self-promotion without authorization

7. Payments and Refunds

Memberships

Mimea offers paid membership tiers (Owl Membership) with recurring billing. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

  • You can cancel your membership at any time from your account settings
  • Cancellations take effect at the end of the current billing period
  • No refunds are provided for partial billing periods

Event Tickets

Event tickets (Garden Sessions, Root Seshion, etc.) are sold through Stripe. Refund policies are displayed on each event page and may vary by event. Generally:

  • Free events do not require refunds (simply don’t attend)
  • Paid events may offer refunds if cancelled more than 7 days before the event
  • No refunds are available within 7 days of the event date
  • Event organizers reserve the right to cancel events and issue full refunds

8. Third-Party Services

Mimea integrates with third-party services including:

  • Stripe for payment processing
  • Phytopedia for educational content
  • YouTube for video hosting and streaming
  • DigitalOcean for hosting infrastructure

Your use of these services is subject to their respective terms of service. We are not responsible for the content, privacy practices, or availability of third-party services.

9. Intellectual Property

If you believe content on Mimea infringes your intellectual property rights, contact us at [email protected] with:

  • A description of the copyrighted work you claim has been infringed
  • The URL or location of the infringing material on Mimea
  • Your contact information (email, phone number, address)
  • A statement that you have a good faith belief the use is not authorized
  • A statement that the information in your notice is accurate
  • Your physical or electronic signature

10. Disclaimers

Educational Content: Mimea provides educational content about plant-based wellness, cannabis, and related topics. This content is for informational purposes only and does not constitute medical, legal, or professional advice. Always consult qualified professionals before making health or legal decisions.

No Warranties: The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, TrustTech Digital (Bevon Co LLC) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform.

12. Indemnification

You agree to indemnify and hold harmless TrustTech Digital, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your User Content
  • Your violation of these Terms
  • Your violation of any third-party rights

13. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violating these Terms or for any other reason. You may delete your account at any time by visiting mimea.co/account/delete.

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that should reasonably survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify registered users via email at least 30 days before the changes take effect. Continued use of the Platform after changes become effective constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of Antigua and Barbuda, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Platform will be resolved in the courts of Antigua and Barbuda.
